Forensic Investigation and Cybercrime Prosecution: A Critical Analysis of Investigative and Judicial Challenges

Abstract

The investigation and prosecution of cybercrime now depend heavily on digital forensic evidence.
However, its unstable, ethereal, and frequently international nature creates ongoing challenges at every
level of the criminal justice system. The main investigative challenges—data volume and volatility,
encryption and anti-forensic techniques, cloud and multi-jurisdictional storage, chain-of-custody integrity,
and capacity constraints—as well as the associated judicial challenges—authentication, admissibility,
expert reliability, disclosure, and judicial technical literacy—are examined in this article. The analysis,
which draws on contemporary case law, institutional reports, and comparative legal trends, demonstrates
that technological advancement constantly surpasses institutional and legal adaptation. The research finds
that uniform cross-border frameworks, standardised forensic procedures, ongoing capacity-building for
judges and investigators, and evidential rules that can handle new hazards like deepfakes and AI-generated
content are necessary for successful cybercrime prosecution.
